Terms & Conditions – SUNREEL (Malta)
1. Company Information
SUNREEL operates private boat charters in Malta. By confirming a booking, the client agrees to the following Terms & Conditions. These terms are governed by the laws of Malta.
2. Booking & Payment
A booking is confirmed upon receipt of the required deposit. The remaining balance must be paid before departure unless otherwise agreed in writing. SUNREEL reserves the right to cancel bookings if payment terms are not respected.
3. Cancellation Policy
Customer cancellations made more than 72 hours before departure may receive a refund of the deposit (minus administrative fees if applicable). Cancellations made within 72 hours may result in loss of deposit.
In case of unsafe weather conditions or force majeure, SUNREEL reserves the right to reschedule the charter or provide a refund at its discretion.
4. Weather Conditions
The Captain has full authority to determine whether sea and weather conditions are safe. If conditions are deemed unsafe, SUNREEL may cancel or modify the route without liability.
5. Charter Duration & Late Return
The charter begins and ends at the agreed time. Late returns caused by the client may incur additional charges. Delays due to weather or safety concerns will be handled at the Captain’s discretion.
6. Passenger Responsibility
The client is responsible for the behavior of all passengers. The maximum passenger capacity must not be exceeded. Children must be supervised at all times.
7. Safety & Conduct
Life jackets and required safety equipment are provided onboard. All passengers must follow safety instructions given by the Captain. Reckless behavior, excessive alcohol consumption, or non-compliance with safety rules may result in immediate termination of the charter without refund.
8. Damage & Liability
The client shall be liable for any damage caused intentionally or through negligence during the charter. SUNREEL is not responsible for loss or damage to personal belongings brought onboard.
9. Mechanical Failure
In the unlikely event of mechanical failure, SUNREEL will make reasonable efforts to resolve the issue or provide an alternative solution. Liability is limited to the charter fee paid.
10. Personal Injury
Participation in marine activities involves inherent risks. By boarding the vessel, passengers acknowledge and accept these risks. SUNREEL shall not be held liable for injuries resulting from failure to follow safety instructions or reckless behavior.
11. Force Majeure
SUNREEL shall not be liable for cancellations or delays caused by events beyond its control, including but not limited to extreme weather, government restrictions, or maritime authority directives.
12. Governing Law
These Terms & Conditions are governed by the laws of Malta. Any disputes shall be subject to the exclusive jurisdiction of the Maltese courts.
